Introduction

Hi there! My name is Lisa McConnell and I provide Kinesiolgy and energy healing packages and 1:1 services, as well as Remedial and Pregnancy Massage Therapy.

I am committed to contributing to excellence in the fields I work in. Understanding that I work in unregulated industries, my intention is to conduct myself in accordance with the standards as outlined in the Code of Ethics of the ATMS – my governing association. This document sets out the Terms and Conditions you need to be aware of when purchasing my services. Please take a moment to read it carefully as it sets out your important rights and obligations and I care about making sure we both know where we stand. When you use my services, you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t accept this agreement, you should notify me immediately so we can discuss your concerns.

My services are offered in compliance with Australian Consumer Law.

1:1 Kinesiology/Energy healing

1:1 Kinesiology/Energy healing is  designed to meet the needs of my clients. Single sessions and packages are available. We set goals/intentions upon commencement of our time together and work towards those goals, based upon the client’s specific requests and requirements.

Remedial and Pregnancy Massage Therapy

Remedial and Pregnancy Massage Therapy is designed to meet the needs of my clients.  Each treatment will include a range of questions and special tests to determine a treatment plan.  All precautions are taken to ensure the comfort of the client, within the scope and framework of massage therapy.

Responsibilities

The advice and information offered in my work is based exclusively on my impressions and experiences. I am qualified in the fields in which I practice, however I do not claim to heal people, I use my skills and knowledge to act as a conduit for the clients own healing. My kinesiology and energy healing is not therapy or a substitute for therapy. If any concerns should arise you are advised to seek advice from a mental health professional. Results are not guaranteed and are based upon the input from the student/client.  You may also be referred to a medical professional for any issues unable to be treated with Massage Therapy.

Limitation of Liability

You agree to indemnify me (hold me blameless) for any injury or illness that you might suffer or any damage or loss that might occur while we are working together. If you have any doubts at all about any issue that might arise, you agree that you will conduct your own research and make your own fully informed decision about what is best for you.

In no event shall I be liable to you for costs, loss or damage of any kind arising out of or related to this Agreement or the services provided in relation to it. If this clause is unenforceable for any reason, my total cumulative liability for all causes of action of any kind shall not exceed the total amount you have paid me for my services.

Any testimonials and promised results that may have influenced you in making this purchase are based on my experience and those of my previous clients. They are not guarantees that anyone else will achieve the same results.

Intellectual Property

The materials and resources that I provide to you are protected by copyright. They are for your personal use only and may not be copied or shared in any way without my written consent.

Confidentiality

Your personal information will be stored securely and kept completely confidential. It will not be shared with anyone. For more information please see my Privacy Policy.

Terms of Payment

Forms of Payment

All online services are to be paid for upfront via the payment gateway through the website. Services provided in person may be paid at the time of appointment, via cash, bank deposit or EFTPOS.

Currency

All prices are in AUD

Security Policy

Online payments are accepted using Square and Paypal and via other calendar management subscription services.

Delivery of Services

Delivery

Most services are delivered to clients online, using Zoom, an online video conference platform. Upon booking you will be sent details on where to join the online meeting at the scheduled time. You must have downloaded the software prior to the call to ensure your appointment time is not impacted. Appointments will not be extended to allow time for software installation if not done prior.

Packages

1:1 packages run on calendar weeks and all sessions must be used before the package ends. Any unused sessions may be forfeited if prior arrangements are not made prior.  In the event of illness or other reason for not completing a weekly session, all efforts will be made by both parties to reschedule. 

Rescheduling and cancellations

Should you need to reschedule a single appointment (not part of a package), please ensure you do so more than 24hrs prior to the appointment time to avoid incurring additional fees. In the case of a no-show by the client, 50% of the session fee will be withheld.

Rescheduling can be done more than 24hrs prior to a single appointment time by clicking the link to reschedule at the bottom of confirmation email or reminder emails. Any rescheduling requests less than 24hrs prior to the scheduled session time must be received via email, may be rescheduled but may incur a 25% administration fee. Due to the small window of time, there is no guarantee that the email will be addressed prior to the scheduled session time.

If you would like to cancel more than 24hrs prior to a single session, you will receive a refund less a 25% admin fee per session. Cancellations within 24hrs of the scheduled appointment will see the full booking amount forfeited.

Appropriate efforts are made to ensure the client is well aware of their scheduled appointment time/s, with an initial confirmation email, plus 1 reminder emails sent. The reminder is sent 24hrs before to the email address used when booking. Any preparations you need to make will also be notified in your email confirmation for your booking. For example, if you would like to record your session, you will need to be on a computer, rather than a tablet or smart phone.

In the unlikely event that I am unable to attend, I will contact the client to advise with as much notice as possible. If the circumstances prevent me offering an opportunity to reschedule immediately, I will endeavour to rectify this as soon as possible, given the circumstances. If you are on a package (more than 2 sessions) any holidays or time off booked will be communicated with you the client, and a solution that suits both of us will be discussed.

Refund Policy

After receiving a service, you are no longer entitled to a refund. If you change your mind part way through a package, please contact me to discuss.  We can reschedule the balance of the program, or refund the unused portion if that is your preference.   

Kinesiology and Massage Therapy

If you are unsure about working with me 1:1 I strongly recommend you contact me before starting so we can both assess the suitability of working together.

Clients who purchase a package, are entering into a financial commitment. Payment are required either up front, or via a payment arrangement.  Refunds and cancellation of packages will be assessed on a case by case basis, please contact Lisa with any concerns.

Consumer Guarantees

In the event of a problem occurring, I will work with you to provide a solution within 7 days of you notifying me of the problem. In the case of a major problem please contact me to discuss the difficulties/issues and to work out a solution.

Jurisdiction & Dispute Resolution

My main place of business is in New South Wales, Australia. This agreement is subject to the governing law of New South Wales. If you have any issue or complaint arising out of your purchase, you and I agree to make a genuine effort to find a win/win solution and resolve the dispute through negotiation and discussion.

If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an accredited mediator. It is a condition precedent to the right of either party to commence litigation other than for interlocutory relief that it has first offered to submit the dispute to mediation. Litigation is to be considered a last resort and may not be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.
